Citizens for Responsibility v. Federal Election Committee
CREW filed a citizen complaint with the Federal Election Commission against New Models, a now-defunct non-profit entity, alleging violations of the Federal Election Campaign Act’s (FECA) registration and reporting requirements for “political committees,” 52 U.S.C. 30109(a)(1). After an initial investigation, the Commission deadlocked 2–2 on whether to proceed; an affirmative vote of four commissioners is required to initiate enforcement proceedings. With only two votes in favor of an enforcement action against New Models, the Commission dismissed CREW’s complaint. Two Commissioners explained that New Models did not qualify as a “political committee” under FECA but stated they were also declining to proceed with enforcement in an "exercise of ... prosecutorial discretion,” given the age of the activity and the fact that the organization appears no longer active.The district court granted the Commission summary judgment, reasoning that a nonenforcement decision is not subject to judicial review if the Commissioners who voted against enforcement “place[] their judgment squarely on the ground of prosecutorial discretion.” The Commission’s “legal analyses are reviewable only if they are the sole reason for the dismissal of an administrative complaint.” The D.C. Circuit affirmed. While FECA allows a private party to challenge a nonenforcement decision by the Commission if it is “contrary to law,” this decision was based in part on prosecutorial discretion and is not reviewable. In Re: Nom. s. of Major, R.
The issue presented for the Pennsylvania Supreme Court's review required the Court to revisit its relatively recent holding that the signature of a registered voter “may not be stricken from a nominating petition solely because the address set forth on the nominating petition is different from the address at which the signer is currently registered to vote.” Following the Court's unanimous decision in In re Vodvarka, 140 A.3d 639 (Pa. 2016), the General Assembly in October of 2019 enacted Act 77, which made significant changes to Pennsylvania’s Election Code, such as the advent of no-excuse mail-in voting. One lesser-known change effected by Act 77 was the amendment of 25 P.S. section 2868, which required a signer of a nominating petition to add certain information. Significantly, only one change was made to the statute by the amendment: the former requirement that a signer add his “residence” was replaced with a new requirement that he add the “address where he is duly registered and enrolled.” After careful review, the Supreme Court concluded this legislative change in statutory text displaced the Court's holding in Vodvarka pertaining to the address requirement. Furthermore, the Court concluded the statute as amended, plainly and unambiguously imposed a mandatory duty on a signer of a nominating petition to add the address where he or she was duly registered and enrolled, and that the failure to comply with this requirement exposes the signature to viable legal challenge. In re Recall of Sawant
Kshama Sawant served on the Seattle City Council since 2013. Ernest Lou, among others, filed recall charges alleging that Councilmember Sawant delegated city employment decisions to a political organization outside city government, used city resources to promote a ballot initiative and failed to comply with public disclosure requirements, disregarded state orders related to COVID-19 and endangered the safety of city workers and other individuals by admitting hundreds of people into Seattle City Hall while it was closed to the public, and led a protest march to Mayor Jenny Durkan’s private residence, the location of which Councilmember Sawant knew was protected under state confidentiality laws. The trial court found these charges factually and legally sufficient for recall. Councilmember Sawant challenged the ballot synopsis. The Washington Supreme Court determined petitioner’s charges that Councilmember Sawant delegated city employment decisions to a political organization outside city government and a portion of the charge that Councilmember Sawant’s actions in divulging the location of Mayor Durkan’s private residence amounted to criminal harassment in violation of RCW 9A.46.020 were legally insufficient. The Court affirmed in all other respects, and declined to address the Councilmember's challenge to the ballot synopsis, because RCW 29A.56.140 provided that “[a]ny decision regarding the ballot synopsis by the superior court is final.” View "In re Recall of Sawant" on Justia Law
Krislov v. Yarbrough
In 2020 Krislov sought to run in the Democratic primary for a position on the Illinois Supreme Court. To get on the ballot he needed 5,050 valid signatures, 0.4% of the votes cast in the same district for the same party’s candidate in the most recent gubernatorial election. He submitted about 9,500 signatures, but many were ruled invalid and his total fell about 100 short. Instead of protesting that decision in state court, Krislov sued in federal court, arguing that falling 100 signatures short of 5,050 is within the margin of error for document examiners. The district court dismissed the case as a state-law challenge to a state-law requirement, which Krislov had forfeited by not using his state remedies and stating that “close enough for government work” is not an available doctrine in Illinois.The Seventh Circuit vacated and remanded with instructions to dismiss for lack of a justiciable controversy. The U.S. Constitution does not require states to ensure that their laws are accurately administered. Accurate adjudication always is in the public interest—as is accurate administration of state law—but federal courts cannot proceed if the plaintiff lacks standing or the proposed remedy would not redress the plaintiff’s injury. The election is over and Krislov cannot establish that the same problem is likely to recur for him, personally; if it does, Krislov is entitled to prompt review in state court. Freedom Found. v. Teamsters Local 117
The Freedom Foundation was a nonprofit organization that describes itself as committed to “advanc[ing] individual liberty, free enterprise and limited, accountable government in the Evergreen State.” The Foundation brought citizen’s actions against Teamsters Local 117; Service Employees International Union Political Education and Action Fund (SEIU PEAF); and Governor Inslee, the Department of Social and Health Services, and Service Employees International Union 775 for various alleged violations of Washington’s Fair Campaign Practices Act (FCPA). In consolidated appeals, the issue common to all was whether the Freedom Foundation satisfied the FCPA’s prerequisites before filing their citizen’s actions. In each case, the superior courts ruled the Foundation failed to meet a 10-day deadline required by the FCPA and, accordingly, entered judgment for respondents. After review, the Washington Supreme Court agreed and affirmed. With respect to the Foundation's suit against the Teamsters Local 117, the Supreme Court determined that though the superior court erred by granting judgment on the pleadings to the union, the court’s entry of judgment would have been proper as summary judgment, and was thus affirmed. This result precluded the Foundation’s other challenges to the superior court’s rulings, which were therefore not addressed. As to the union's cross-appeal of its counterclaim against the Foundation under 42 U.S.C. 1983, the Foundation was not a state actor, was not wielding powers traditionally and exclusively reserved to the State, and therefore was not subject to suit under section 1983. South Carolina Public Interest Foundation v. Calhoun County Council
Voters in Calhoun County, South Carolina, approved a referendum in the November 2018 general election imposing a one percent sales and use tax ("a penny tax") to fund a list of fifteen projects. Nearly five months later, Appellants filed suit, contending four of the projects were not authorized pursuant to section S.C. Code Ann. sections 4-10-300 to -390 (2019). The County responded that the statute of limitations had expired, and alternatively, the projects fell within the scope of the Act. The circuit court found the thirty-day limitations period barred the action and did not address the merits. Early v. Bacerra
Xavier Becerra and his election committee (collectively, Becerra) successfully defended a petition for writ of mandate brought by Eric Early and his election committee (collectively, Early) seeking to remove Becerra as a candidate for California's Attorney General on the November 2018 ballot. The Court of Appeal affirmed the trial court's decision denying the petition. Early alleged that Becerra was ineligible for the office of Attorney General because his state bar status was “inactive” during the five years preceding the election and therefore he was not “admitted to practice” in the state as required for that period under Government Code section 12503. We held that the phrase “admitted to practice” in the statute “refers to the event of admission to the bar and the status of being admitted, and does not require engagement in the ‘actual’ or ‘active’ practice of law.” Becerra brought a motion for attorney fees under Code of Civil Procedure section 1021.5, which the trial court granted awarding Becerra $69,718 in attorney fees. "Becerra's successful defense of the petition enforced an important public right and conferred a significant benefit on the general public as required by subdivision (a) of section 1021.5. . . . Further, the trial court did not abuse its discretion in determining under subdivision (b) of section 1021.5 that the financial burden Becerra incurred in defending Early’s suit outweighed any pecuniary benefit in the form of the salary paid to the Attorney General or otherwise." Committee to Elect Dan Forest v. Employees Political Action Committee
The Supreme Court held that the North Carolina Constitution does not limit the jurisdiction of the state's courts in the same manner as the standing requirements that U.S. Const. art III, section 2 imposes on federal courts, including the requirement that the complaining party must show she has suffered "injury in fact," even where N.C. Gen. Stat. 163-278.39A(f) (now repealed) expressly conferred standing to sue on a party.In 1999, the North Carolina General Assembly enacted the "Disclosure Statute," section 163-278.38Z et seq., providing specific requirements for television and radio ads placed by political action committees. Plaintiff's complaint alleged two violations of the Disclosure Statute by the Employees Political Action Committee (EMPAC). The trial court granted summary judgment to EMPAC, concluding that Plaintiff had failed to allege actual demonstrable damages. The court of appeals reversed. The Supreme Court affirmed in part, holding that when a person alleges the infringement of a legal right directly under a cause of action at common law, a statute, or the North Carolina Constitution, the legal injury itself gives rise to standing. Carney v. Adams
Delaware’s Constitution contains a political balance requirement for appointments to the state’s major courts. No more than a bare majority of judges on any of its five major courts “shall be of the same political party.” Art. IV, section 3. On three of those courts, those members not in the bare majority “shall be of the other major political party.” Adams, a Delaware lawyer and political independent, sued, claiming that those requirements violate his First Amendment right to freedom of association by making him ineligible to become a judge unless he joins a major political party.The Supreme Court held that because Adams has not shown that he was “able and ready” to apply for a judicial vacancy in the imminent future, he failed to show a “personal,” “concrete,” and “imminent” injury necessary for Article III standing. A grievance that amounts to nothing more than abstract and generalized harm to a citizen’s interest in the proper application of the law is not an “injury in fact.” Adams must at least show that he is likely to apply to become a judge in the reasonably foreseeable future if not barred because of political affiliation. Adams’ only supporting evidence is his statements that he wanted to be, and would apply to be, a judge on any of Delaware’s courts. The evidence fails to show that, when he filed suit, Adams was “able and ready” to apply for a judgeship in the reasonably foreseeable future. Adams’ statements lack supporting evidence, like efforts to determine possible judicial openings or other preparations. Adams did not apply for numerous existing judicial vacancies while he was a registered Democrat. He then read a law review article arguing that Delaware’s judicial eligibility requirements unconstitutionally excluded independents, changed his political affiliation, and filed suit. In Re: Canvassing Observ.
This appeal arose from the processing of mail-in and absentee ballots received from voters in Philadelphia County in the November 3, 2020 General Election. Specifically, Appellee Donald J. Trump, Inc. (the “Campaign”) orally moved for the Philadelphia County Court of Common Pleas to give its representative more proximate access to the canvassing activities being carried out by Appellant, the Philadelphia County Board of Elections (the “Board”). The trial court denied relief, the Commonwealth Court reversed, and the Board appealed that order. The Pennsylvania Supreme Court concluded the Board did not act contrary to law in fashioning its regulations governing the positioning of candidate representatives during the pre-canvassing and canvassing process, as the Election Code did not specify minimum distance parameters for the location of such representatives. Critically, the Court found the Board’s regulations as applied herein were reasonable in that they allowed candidate representatives to observe the Board conducting its activities as prescribed under the Election Code. Accordingly, the Court determined the Commonwealth Court’s order was erroneous, and vacated that order. The trial court's order was reinstated. View "In Re: Canvassing Observ." on Justia Law
