A Maryland law requiring newspapers, among other platforms, to publish on their websites, as well as retain for state inspection, certain information about the political ads they decide to carry, violates the First amendment. The Fourth Circuit affirmed the preliminary injunctive relief awarded by the district court and explained that, while Maryland's law tries to serve important aims, the state has gone about this task in too circuitous and burdensome a manner to satisfy constitutional scrutiny. The court agreed with the district court that the law is a content-based law that targets political speech and compels newspapers, among other platforms, to carry certain messages on their websites. The court declined to decide whether strict or exacting scrutiny should apply to a disclosure law like the one at issue, and held that the law failed under the more forgiving exact scrutiny standard. The San Diego County (County) Board of Supervisors approved an amendment to the County's general land use plan, which would have allowed for the development of over 2,100 homes in a previously designated rural area of the County. Residents opposed to the change in land use circulated a referendum petition and gathered enough signatures to have the matter placed on an election ballot. To prevent an election, the land developer filed a petition for writ of mandate, contending the referendum petition was illegal and void as a matter of law. The court denied the writ petition. The issues this case presented for the Court of Appeal's review were: (1) whether the referendum petition complied with the full text requirement under Elections Code section 91471; and (2) the referendum petition's legality in challenging a single legislative act even though the Board of Supervisors executed several concurrent, associated legislative acts. The Supreme Court exercised its original jurisdiction to entertain an emergency petition for a writ of mandate that would forbid the Secretary of State from enforcing portions of the recently enabled Presidential Tax Transparency and Accountability Act, Cal. Elec. Code 6880 et seq. The Supreme Court granted that writ, holding that portions of the Act conflict with Cal. Const. art. II, 5(c) and are therefore invalid.Specifically, the Court held that Elections Code sections 6883 and 6884 are invalid under article II, section 5(c) insofar as they require someone who is recognized as a candidate for the office of President of the United States to file with the Secretary of State federal income tax returns for the five most recent taxable years as a necessary condition for appearing on the primary election ballot of a qualified political party. The Court held that this additional prerequisite conflicts with the California Constitution's specification of an inclusive open presidential primary ballot and therefore cannot lawfully be enforced. Plaintiff filed suit alleging that Missouri's lobbying requirements violate his freedom of speech and right to petition the government, and that the law is facially invalid because ordinary citizens do not have fair notice of whom it covers. The Eighth Circuit vacated the district court's order denying plaintiff a preliminary injunction.The court held that Missouri's application of the law to plaintiff violates the First Amendment, because his political activities did not involve the transfer of money or anything of value, either to him or anyone else, and Missouri's interest in transparency did not reflect the seriousness of the actual burden on his First Amendment rights. The court also held that, even though the law does not define or otherwise explain what "designated" means, it is not vague. Instead, the court applied the word's common and ordinary meaning, in context, and held that, just because the law is broad does not mean that it is ambiguous, much less constitutionally vague. Petitioners challenged the 2018 election for lieutenant governor, an election in which more than 3.7 million Georgians cast a vote. They alleged defects in electronic voting machines cast doubt on the election in which Geoff Duncan defeated Sarah Riggs Amico by 123,172 votes. To prevail, a party contesting an election must therefore offer evidence, not merely theories or conjecture, that places in doubt the result of an election. "And although the technology our State has used to conduct elections has changed over time, the burden a party carries when challenging the result of an election has not. Arthur West appealed a judgment finding the charges in his petition to recall Washington Governor Jay Inslee to be legally and factually insufficient to submit to voters. In his recall petition, West alleged the governor was absent from Washington too frequently and failed to properly notify the lieutenant governor of these absences, failed to declare homelessness a statewide emergency, and improperly campaigned for a ballot initiative. The trial court held that the charges were factually and legally insufficient. The Washington Supreme Court found that while West's petition may have stated reasons to disagree with Governor Inslee, but they were not proper reasons to support a recall. Plaintiffs filed a putative class action alleging that during the 2016 Democratic presidential primaries the DNC and its chairwoman improperly tipped the scales in favor of former Secretary of State Hillary Clinton, who was challenging Senator Bernie Sanders for the Democratic presidential nomination.The Eleventh Circuit held that some named plaintiffs representing the DNC donor class have adequately alleged Article III standing, but that no named plaintiffs representing the Sanders donor class have done so. The court dismissed the fraud and negligent misrepresentation claims on the merits, holding that plaintiffs representing the DNC donor class failed to allege with particularity the manner in which they relied on defendants' statements. Therefore, the general allegation of reliance was not fatal to the Article III standing of the DNC donor class, but it fell short of Federal Rule of Civil Procedure 9(b)'s heightened pleading standard.The court also held that the District of Columbia Consumer Protection Procedures Act claim of the DNC donor class failed the plausibility standard set out in cases like Bell Atlantic Corp. v. Twombly, 550 U.S. 544, 556–57 (2007); plaintiffs in the DNC donor class have failed to state a claim for unjust enrichment under Florida law; plaintiffs in the Democratic voter class failed to allege an injury-in-fact sufficient to confer Article III standing when they alleged a breach of fiduciary duty by the DNC and its chairwoman; and the district court did not err in dismissing the complaint without sua sponte granting plaintiffs leave to file a second amended complaint. Petitioner Edward Shadid challenged Oklahoma City Ordinance No. 26,255 (Ordinance)1 which was passed by the City Council of Oklahoma City and signed by the Mayor on September 24, 2019. The Ordinance amended Article II of Chapter 52 of the Oklahoma City Municipal Code, 2010, by creating a new Section 52-23.7. This amendment created a temporary term (8 year) excise tax of 1% to begin April 1, 2020, if approved by a majority vote of qualified, registered voters of Oklahoma City. A special election was set for this purpose on December 10, 2019. Petitioner contends the Ordinance violates the single subject rule found in art. 5, sec. 57, Okla. Const. The Oklahoma Supreme Court assumed original jurisdiction to respond to Petitioner's challenge, and concluded the proposed ordinance did not violate the single subject rule found in the Oklahoma Constitution or the single subject rule found in state statute and City of Oklahoma City's charter. The Supreme Court denied the petition for extraordinary writ sought by advocates for a statewide ballot initiative called the Direct Primary Initiative, holding that Petitioners' statutory claims and all but one of the constitutional claims failed on the merit and that Petitioners failed to carry their burden of identifying an undisputed basis for the relief requested.Petitioners - Count My Vote, Inc., Michael O. Leavitt, and Richard McKeown - were advocates for a proposed initiative that would establish a direct primary election path for placement on the general election ballot for persons seeking a political party's nomination for certain elected offices. The lieutenant governor refused to certify the initiative for the November 2018 ballot, finding that Petitioners failed to satisfy the requirements of Utah Code 20A-7-201(2)(a). Petitioners then brought this petition for extraordinary writ on statutory and constitutional grounds. The Supreme Court denied the petition, holding (1) the majority of Petitioners' statutory and constitutional claims failed on the merits; (2) one of the constitutional claims implicates an underlying dispute of material fact on the nature and extent of any burden on the right to pursue an initiative under Utah Const. art. Petitioner Julie Parrish challenged the Attorney General’s certified ballot title for Initiative Petition 13 (2020) (IP 13). Intervenor Uherbelau intervened generally in support of the Attorney General’s certified ballot title. If adopted, IP 13 would amend Article IX of the Oregon Constitution to add a new section, section 16. Subsection 16(1) would require the State Treasurer to “calculate the unfunded actuarial liability of any public employee retirement program or system as of December 31, 2022.” The Oregon Supreme Court reviewed the ballot title for substantial compliance with ORS 250.035(2). After review, the Supreme Court concluded the ballot title for IP 13 did not substantially comply with ORS 250.035(2) in several respects, and therefore referred it to the Attorney General for modification.
