Thomas v. Bryant
After the district court found that the boundaries for Mississippi State Senate District 22 dilute African-American voting strength and prevented those citizens from having the equal opportunity "to participate in the political process and to elect representatives of their choice" that the Voting Rights Act guarantees, the district court switched 28 precincts between District 22 and a bordering district to remedy the violation. The Governor and Secretary of State sought a stay of the district court's final judgment.The Fourth Circuit granted in part and denied in part defendants' motion for a stay. The court held that the rule of construction, the text of the three-judge statute, its lineage, and the caselaw applying it all favor the district court's view that three judges are not required for a claim raising only statutory challenges to state legislative redistricting. The court also held that defendants have not shown a high likelihood of overturning the finding of vote dilution because their legal argument was at odds with "unimpeachable authority" from this court and their factual challenges must overcome deferential standards of review. The court rejected defendants' laches claim.However, the court held that the legislature should have the initial opportunity to draw new lines for District 22 that comply with the Voting Rights Act. Accordingly, the court issued an order granting a temporary stay to allow the legislature to remedy the Section 2 violation. Finally, the court held that defendants have not demonstrated a high likelihood of showing that the district court's narrow redraw was an abuse of discretion, and there was no risk of voter confusion and no outcry from state officials that implementing the district court’s remedy substantially disturbed its election process. Boyer v. Ventura County
The Court of Appeal denied a petition for writ of mandate seeking to compel defendants to put plaintiff on the primary election ballot for county sheriff. The court affirmed the trial court's ruling that Government Code section 24004.3, which required persons to be elected county sheriff to meet certain law enforcement experience and education, is constitutional. The court explained that there was good reason why the Legislature imposed an experience requirement because, in order to have a true understanding of law enforcement, you must learn about it in the field doing it.The court held that the state Constitution empowers the Legislature to provide for the election of county sheriffs and to set minimum qualifications for sheriff candidates. The court rejected the argument that section 24004.3 conflicts with or was preempted by the California Constitution. The court also held that there was no merit to the argument that the Legislature exceeded its authority pursuant to the California Constitution in enacting section 24004.3 or that the statute violates the First Amendment rights of would-be candidates or the voters at large. Finally, the trial court reasonably concluded that plaintiff's delay in filing and prosecuting the writ petition was prejudicial. View "Boyer v. Ventura County" on Justia Law
Democratic Executive Committee of Florida v. Lee
This case involved Florida's practice of counting vote-by-mail ballots only after verifying that the voter's signature provided with the ballot matches the voter's signature in the state's records. At issue in this appeal was NRSC's motion for emergency stay.The court denied NRSC's motion and held that NRSC failed to satisfy the requirements for the issuance of a stay. The court applied the factors in Nken v. Holder, 556 U.S. 418, 434 (2009), and held that NRSC has not made a strong showing that it was likely to succeed on appeal. In this case, NRSC has not made a strong showing that the burden imposed on the right to vote is constitutional as judged by the Anderson-Burdick balancing test and NRSC has not made a strong showing that it was likely to succeed on the merits of its laches argument. Unite New Mexico v. Oliver
The New Mexico Secretary of State sought to reinstate straight-ticket voting in the November 2018 general election. A coalition of voters, political parties, and political organizations (Petitioners) sought mandamus relief from the New Mexico Supreme Court to order the Secretary to stop and make no further efforts to reinstate the straight-ticket option on grounds that she did not possess authority to do so. "Whether straight-ticket voting shall once more be a ballot option in general elections in New Mexico is a policy question for our Legislature. The Legislature cannot delegate election policy determinations." The Court concluded the Secretary’s efforts without legislative approval violated separation of powers principles and was unlawful. Adams v. Governor of Delaware
Adams, a resident and member of the State Bar of Delaware, wanted to be considered for a state judicial position. Following the announcement of several judicial vacancies, Adams considered applying but ultimately chose not to because the announcement required that the candidate be a Republican. Because Adams was neither a Republican nor a Democrat, he concluded that any application he submitted would be futile. Adams challenged the Delaware Constitution's provision that effectively limits service on state courts to members of the Democratic and Republican parties, citing Supreme Court precedent: A provision that limits a judicial candidate’s freedom to associate (or not to associate) with the political party of his choice is unconstitutional. The governor responded that because judges are policymakers, there are no constitutional restraints on his hiring decisions. The Third Circuit ruled in favor of Adams, concluding that judges are not policymakers because whatever decisions judges make in any given case relates to the case under review and not to partisan political interests. The portions of Delaware’s constitution that limit Adams’s ability to apply for a judicial position while associating with the political party of his choice violate his First Amendment rights. Issa v. Applegate
During the course of the 2016 political campaign to represent the 49th Congressional District, challenger candidate Doug Applegate's campaign ran two television advertisements about incumbent Darrell Issa that Issa contends were false and defamatory. Issa filed a lawsuit against Applegate, Doug Applegate for Congress, Inc., and Robert Dempsey (the respondents), alleging libel based on statements made in these two television advertisements. The trial court granted the respondents' anti-SLAPP motion and entered judgment in favor of the respondents on Issa's complaint. Issa appealed. While "[i]t is abhorrent that many political campaigns are mean- spirited affairs that shower the voters with invective instead of insight[,]" in order "to ensure the preservation of a citizen's right of free expression, we must allow wide latitude." The Court of Appeal ultimately concluded the trial court properly granted the respondents' anti-SLAPP motion because Issa could not demonstrate the statements about which he complained were demonstrably false statements of fact. Washington v. Evergreen Freedom Found.
This case involved statutory interpretation concerning application of the reporting requirements contained in the Washington Fair Campaign Practices Act (FCPA), chapter 42.17A RCW. The specific issue presented was how the FCPA reporting requirements in RCW 42.17A.255 and the definition in RCW 42.17A.005(4) ("ballot proposition") were to be applied in the context of local initiatives. In 2014, Evergreen Freedom Foundation (EFF) staff created sample municipal ordinances and ballot propositions for citizens to use to advance certain causes to their local city councils or commissions. Local residents in the cities of Sequim, Chelan, and Shelton used those samples in filing two ballot propositions in each city, one to require collective bargaining negotiation sessions to be publicly conducted and the second to prohibit union security clauses in city collective bargaining agreements. The proponents submitted the proposed measures to their local city clerks along with signatures they had gathered in support of the measures, and asked their respective city councils or commissions either to pass the measures as local ordinances or, if the councils or commissions did not agree, to alternatively place each measure on the local ballot for a vote. None of the cities passed the measures as ordinances or placed the ballot propositions on the local ballots. In response, EFF employees, who were attorneys, participated in lawsuits against each jurisdiction on behalf of the local resident proponents, each suit seeking a judicial directive to the respective city to put each measure on the local ballot. Each lawsuit ended in a superior court dismissing the case, and those decisions were not appealed. EFF did not file any campaign finance disclosure reports identifying the value of the legal services it provided to the resident proponents in support of the local ballot propositions. The State conducted an investigation and then filed a civil regulatory enforcement action against EFF alleging EFF failed to report independent expenditures it made in support of the noted local ballot propositions. The Washington Supreme Court affirmed the Court of Appeals' reversal of the trial court's 12(b)(6) dismissal of the State's regulatory enforcement action under the FCPA: under the circumstances of this case, EFF's pro bono legal services were reportable. The applicable reporting statutes were not unconstitutionally vague, nor did their application here violate EFF's First Amendment rights. View "Washington v. Evergreen Freedom Found." on Justia Law
6th Congressional District Republican Committee v. Alcorn
Virginia's Incumbent Protection Act, Va. Code Ann. 24.2-509(B), violates the First Amendment of the Constitution. Subsection 24.2-509(B) limits the broad authority recognized by subsection A, which empowers the duly constituted authorities of the state and local parties to determine the method by which a party nomination shall be made.The Fourth Circuit affirmed the district court's decision to permanently enjoin enforcement of the entire Act. The court agreed with the district court's finding that the fourth sentence of the Act, which protects the nomination prerogatives of incumbent members of Congress among others, violated the First Amendment because it imposed a severe burden on the associational rights of Virginia's political parties and the Commonwealth has been unable to show that it is narrowly tailored to serve a compelling state interest.The court also agreed with the district court's decision to enjoin the Act's second and third sentences, which protect the nomination prerogatives of incumbent members of the General Assembly. The court held that the Committee had standing to challenge these provisions and that they were, if anything, even more offensive to the First Amendment than the fourth sentence. Protect Pub. Health v. Freed
Proposed Initiative 27 (I-27) would have allowed King County, Washington voters to decide whether to ban public funding for community health engagement location (CHEL) sites, colloquially known as safe injection sites, and to create civil liability for any person or entity who operates a site. The King County Superior Court granted respondent Protect Public Health's ("PPH") motion for declaratory judgment and injunctive relief, and enjoined King County from placing I-27 on the ballot. The issue this case presented for the Washington Supreme Court's review was whether the proposed initiative was beyond the scope of the local initiative power. The Court affirmed the superior court, holding I-27 was outside the scope of local initiative power because it improperly interfered with the budgetary authority of the King City Council. Soltysik v. Padilla
Plaintiff, a candidate for public office in California, challenged the California Elections Code, which mandated that the primary ballot list his party preference as "None" instead of the Socialist Party USA.The Ninth Circuit reversed and remanded, holding that California, at this very early stage of the litigation, failed to demonstrate as a matter of law why its ballot must describe plaintiff as having no party preference when in fact he preferred the Socialist Party USA. The panel agreed with the Secretary of State that the burden the California statutes imposed on plaintiff's First and Fourteenth Amendment rights was not severe. However, the burden imposed on plaintiff's rights was more than "slight" and warranted scrutiny that was neither strict nor wholly deferential. In this case, the primary purported justification for the statutes—avoiding voter confusion—was an important government interest, but it was unclear why less burdensome and less misleading alternatives would not accomplish the state's goals.
