Libertarian Party of Illinois v. Cunningham
Under Illinois law, a political party that has not attained sufficient votes in past elections must field candidates for all offices on the ballot in the political subdivision in which it wishes to compete. In the 2012 election, the Libertarian Party could field a candidate for Kane County auditor only if it also proposed candidates for six other offices. In its suit under 42 U.S.C. 1983, the Party argued that the full-slate requirement violated its right of political association under the First and Fourteenth Amendments. The Seventh Circuit agreed, rejecting an argument that the requirement is justified by its interests in political stability, preventing ballot overcrowding, and avoiding voter confusion. The core of the fundamental right to political association is the right to band together in a political party to advance a policy agenda by electing the party’s members to office. That necessarily includes the candidates’ right to appear on the ballot under the party banner. For a minor party and its nominees, Illinois’s full-slate requirement extinguishes those rights unless the party fields candidates in races it may want no part of. This is a severe burden on fundamental constitutional rights. Illinois has not offered a compelling state interest to justify it. By incentivizing minor parties to manufacture frivolous candidacies, the full-slate requirement actually thwarts the interests Illinois invokes. View "Libertarian Party of Illinois v. New Hampshire v. Gibson
The State appealed a superior court order granting news reporter Nicholas Reid’s (Reid) motion to quash the State’s subpoena compelling him to testify against defendant Carl Gibson. Republican candidate Yvonne Dean-Bailey (Dean-Bailey) was running in a May 19, 2015 special election for State Representative from Rockingham County District 32. On May 14, 2015, the defendant, a volunteer for the opposing Democratic Party candidate, allegedly issued a false press release stating that Dean-Bailey was dropping out of the race. Reid, who was covering the special election as a reporter for the Concord Monitor, received the e-mail with the attached press release and became suspicious because of the form and content of the e-mail and attached file. He contacted a representative of the New Hampshire Republican Party who was unaware of Dean-Bailey withdrawing from the race. Reid then wrote a short article for the May 15, 2015 issue of the newspaper titled “Email claiming Dean-Bailey is conceding called a hoax.” Reid reviewed the metadata of the press release which lead to him finding a way to contact Gibson. Based upon that conversation and his conversations with other sources, Reid wrote a second article published in the Concord Monitor on May 16 under the headline, “Man who sent hoax email from GOP candidate had ‘too many beers’ before ‘prank.’” Defendant was ultimately charged with “False Documents, Names or Endorsements,” attempted voter suppression, and voter suppression. Reid was served with a subpoena requiring him “to testify what [he] know[s] relating to a criminal matter to be heard and tried between the State . . . and Carl Gibson.” Reid moved to quash the subpoena on the ground that it violated his “newsgathering privilege” under Part I, Article 22 of the New Hampshire Constitution and the First Amendment to the United States Constitution. On appeal, the State argued that the trial court erred “by expanding the scope of the news-gathering privilege to include non-confidential sources.” Although Reid based his motion to quash upon the ground that it violated his newsgathering privilege under the State and Federal Constitutions, the trial court based its decision solely upon the State Constitution. The New Hampshire Supreme Court held the trial court’s determination was erroneous, and remanded for the trial court to consider, in the first instance, Reid’s federal constitutional claim. Cook County Republican Party v. Sapone
The Republican Party sued the Cook County Board of Election Commissioners, arguing that the Board must include on the ballot a candidate that the Party slated for the House of Representatives in the November 2016 election. The Board had never announced a plan to exclude the candidate. The district court entered an injunction compelling the Board to keep this candidate on the ballot. The Seventh Circuit remanded with instructions to dismiss for lack of subject matter jurisdiction. The Party’s dispute with two additional defendants, elected as ward committeemen, based on the Party’s refusal to seat them, is not a federal claim. The Party’s “anticipatory federal contention,” that ”if state law does not respect the Party’s eligibility rules, then Illinois violates the First Amendment,” was only a potential response to a potential contention by the committeemen that all elected ward committeemen must be seated on the Party’s central committee. The district judge did not consider the fact that public officials were not contesting the Party’s claims or the possibility that he was issuing an advisory opinion. If the committeemen had sued the Party, demanding membership on its central committee, their claim would have arisen under Illinois law. View "Cook County Republican Party v. Sapone" on Justia Law
Veasey v. Abbott
The Texas Legislature enacted SB 5 in 2016 to cure any statutory and constitutional violations related to SB 14 after Veasey v. Abbott, 830 F.3d 216 (5th Cir. 2016) (en banc). The district court permanently enjoined the enforcement of relevant sections of SB 14 and SB 5 and also enjoined upcoming elections under an interim order. The Fifth Circuit granted a stay pending appeal, stayed the district court's injunction orders, and stayed proceedings in the district court until a final disposition of this appeal. In this case, SB 5 allows voters without qualifying photo ID to cast regular ballots by executing a declaration that they face a reasonable impediment to obtaining qualifying photo ID. The court explained that this declaration is made under the penalty of perjury, and each of the 27 voters identified—whose testimony the plaintiffs used to support their discriminatory-effect claim—can vote without impediment under SB 5. The court held that the State has made a strong showing that it is likely to succeed on the merits because its reasonable-impediment procedure remedies plaintiffs' alleged harm and foreclosed plaintiffs' injunctive relief. The State has also made an adequate showing as to the other factors considered in determining a stay pending appeal. View "Veasey v. Abbott" on Justia Law
Johnson v. Commission on Presidential Debates
Plaintiffs, the Libertarian Party's presidential and vice presidential candidates in the 2012 elections, filed suit claiming that they were excluded pursuant to an agreement between the Obama for America and Romney for President campaigns. Plaintiffs alleged that the parties' agreement reflected in a memorandum of understanding (MOU) stipulated to three presidential debates and one vice presidential debate, and designated dates, locations, moderators, and topics. Plaintiffs challenged the MOU as an unlawful agreement to monopolize and restrain competition in violation of sections 1 and 2 of the Sherman Act, 15 U.S.C. 1–2. The DC Circuit affirmed the district court's dismissal of the case. The court held that the doctrine of constitutional avoidance permitted the court to resolve this case on alternative grounds, based on antitrust standing. The court explained that the injuries plaintiffs claim were simply not those contemplated by the antitrust laws. Furthermore, plaintiffs failed to allege a clear legal claim, let alone identified a cognizable injury, in regard to their First Amendment claim. View "Johnson v. California Cannabis Coalition v. Upland
The Supreme Court of California held that, in light of the text and other indicia of the purpose associated with the relevant constitutional and statutory provisions, Cal. Const., art. XIII C, section 2 does not limit voters' power to raise taxes by statutory initiative. The court explained that a contrary conclusion would require an unreasonably broad construction of the term "local government" at the expense of the people’s constitutional right to direct democracy, undermining the longstanding and consistent view that courts should protect and liberally construe it. In this case, the California Cannabis Coalition drafted a medical marijuana initiative proposing to repeal an existing City ordinance. The Coalition subsequently petitioned for a writ of mandate when the City failed to submit the initiative to the voters at a special election. The supreme court affirmed the court of appeal's holding that article XIII C, section 2 only governs levies that are imposed by local government, and thus directed the superior court to issue a writ of mandate compelling the City to place the initiative on a special ballot in accordance with Elections Code section 9214. OCA-Greater Houston v. Texas
The limitation on voter choice expressed in Tex. Elec. Code 61.033 impermissibly narrows the right guaranteed by Section 208 of the Voting Rights Act. In this case, OCA challenged the Texas voting law, which imposes a restriction on the interpretation assistance that English-limited voters may receive. The district court entered summary judgment for OCA and issued an injunction against Texas. After determining that it had jurisdiction, the Fifth Circuit held that the VRA validly abrogated state sovereign immunity; the Texas statute could not restrict the federally guaranteed right to the act of casting a ballot by enacting a statute tracking its language, then defining terms more restrictively than as federally defined; but the injunction exceeded the scope of the parties' presentation. Accordingly, the court vacated the injunction and remanded for the entry of a new injunction. The court affirmed in all other respects. View "OCA-Greater Houston v. Texas" on Justia Law
Keim v. Douglas County School District
The Colorado Supreme Court held that under section 2(5)(a)(IV) of the Colorado Constitution, a campaign “contribution” required that: (1) something of value (2) be given to a candidate, directly or indirectly, (3) for the purpose of promoting the candidate’s nomination, retention, recall, or election. Here, a school district commissioned and paid for a "white paper" report supportive of the district’s reform agenda using public funds. Petitioner Julie Keim was a candidate for one of four open seats in the 2013 school board election. According to Keim, after the 2009 school board election, the District began implementing a conservative “reform agenda,” which she characterized as “[school] choice-focused” and supportive of charter schools. The 2011 election brought in three additional reform agenda board members; thereafter, the entire board and the District’s superintendent unanimously supported the reform agenda. In 2013, four school board seats were up for election. In February of that year, the District contracted with the American Enterprise Institute (“AEI”) to prepare a white paper about the school system. Shortly thereafter, Keim filed a campaign finance complaint against the District with the Secretary of State alleging the District “violated the [Fair Campaign Practices Act, "FCPA"] . . . by using district resources to influence the outcome of the school board election.” Because the school district did not give something, directly or indirectly, to any candidate when it publicly disseminated an email containing a link to the report, the Supreme Court concluded the school district did not make a prohibited “contribution” under Colorado campaign finance provisions. King Street Patriots v. Texas Democratic Party
The Texas Democratic Party sued King Street Patriots (Defendant) alleging noncompliance with Election Code provisions imposing restraints and obligations on “political committees” and corporations. Defendant, in turn, argued that certain statutory provision impermissibly burdened its constitutional rights. The parties agreed to sever Defendant’s facial challenges from its as-applied challenges. Following severance, the trial court found the challenged Election Code provisions facially valid. The Court of Appeals reversed. The Supreme Court affirmed in part and vacated in part, holding (1) legislatively enacted bans on corporate political contributions are constitutional under the First Amendment; (2) the Legislature’s public policy choice to authorize a private right of action passes constitutional muster; (3) the Election Code’s campaign contribution and political contribution definitions are not unconstitutionally vague; and (4) as to Plaintiff’s challenge to the Code’s political committee definitions, that issue is premature and prudentially unripe. Specifically, adjudication of Plaintiff’s facial challenge to the political committee definitions is premature because Plaintiff is not a political committee, and therefore, Plaintiff’s as-applied challenges should be adjudicated before facial constitutionality of the political committee definitions is determined. North Carolina v. Covington
The North Carolina General Assembly redrew state legislative districts in 2011 to account for population changes revealed by the 2010 census. Plaintiffs alleged that 28 majority-black districts in the new plan were unconstitutional racial gerrymanders. The district court ruled for the plaintiffs in August 2016, declined to require changes before the November 2016 election, but ordered the General Assembly to redraw the map. Three weeks after the November 2016 election, the court set a March 2017 deadline for drawing new districts, ordering that “[t]he term of any legislator elected in 2016” from a district later redrawn would be replaced by new ones, to be chosen in court-ordered special elections in fall, 2017, to serve a one-year term. The court suspended provisions of the North Carolina Constitution requiring prospective legislators to reside within a district for one year before they may be elected to represent it. The Supreme Court granted a stay pending appeal and subsequently vacated the remedial order. Relief in redistricting cases is “‘fashioned in the light of well-known principles of equity.’” The district court “addressed the balance of equities in only the most cursory fashion.” In determining whether or when a special election may be a proper remedy for a racial gerrymander, obvious considerations include the severity and nature of the particular constitutional violation, the extent of the likely disruption to the ordinary processes of governance if early elections are imposed, and the need to act with proper judicial restraint when intruding on state sovereignty.
