Brannon v. City of Coeur D’Alene
This case appealed a district court's denial of Petitioner Jim Brannon's election contest of the Coeur d'Alene city council election in 2009. In the official vote total, Brannon lost the election for seat 2 of the city council to Mike Kennedy by five votes. Brannon then filed an election contest that alleged numerous irregularities and sought to set aside, void, or annul the election. After a bench trial, the district court issued a memorandum decision that affirmed the election result, finding insufficient illegal votes or irregularities to change the outcome of the election. On appeal, Brannon argued that the City delegated its election duties to Kootenai County in contravention of Idaho law, that the district court made numerous factual and legal errors at trial, and that the district court erred in denying Brannon's motion to disqualify and motion for new trial. Upon review and finding no error, the Supreme Court affirmed the decision of the district court.

Republican Party of Conn. v. Merrill
Plaintiff, the Republican Party of Connecticut, brought a declaratory judgment action in which it sought a determination that, because its candidate for the office of governor in the 2010 election received the highest number of votes under the designation of the Republican Party line on the ballot, Defendant, the secretary of the state, was required to list the candidates of the Republican Party first on the ballots for the 2010 election pursuant to Conn. Gen. Stat. 9-249a(a). The trial court granted the joint request of the parties to reserve questions regarding the statute for the Supreme Court. The Court answered, (1) Plaintiff had an available administrative remedy in the present case, which it exhausted; (2) Plaintiff's complaint was not barred by sovereign immunity; and (3) section 9-249a requires that the Plaintiff's candidates for office be placed on the first line of the ballots for the November 6, 2012 election. In re Bond Issuance of Greater Wenatchee Reg’l Events Ctr.
The Washington constitution limits municipal indebtedness to protect taxpayers from legislative and voter improvidence. The issue before the Supreme Court centered on whether the city of Wenatchee (City) would exceed its debt limit by entering into a "contingent loan agreement" (CLA) with appellant Greater Wenatchee Regional Events Center Public Facilities District (District) to help the District finance a regional events center. The District argued that the CLA was not subject to the City's debt limit because it created a "contingent" liability, triggered only if the District is unable to make payments on the District's bonds. Upon review, the Supreme Court rejected this argument because the City was unconditionally obligated to service the District's debt if the District could not and because the risk of loss fell upon the City and its taxpayers: "[o]ur decision accordingly places the approval of the CLA in the hands of the voters."

Citizens Against Slots At The Mall v. PPE Casino Resorts Md., LLC
This was the latest in a series of opinions by the Court of Appeals involving the constitutional provision and the implementing legislation authorizing a limited number of slot machines at specified Maryland facilities, including facilities in the area of Anne Arundel County (County). A County zoning ordinance authorized slot machines in certain areas of the County. The circuit court determined that the ordinance was not subject to referendum under the County charter. On appeal, the Court of Appeals (1) held the circuit court's judgment was appealable, as (i) the Legislature no no intention of applying the non-appealability principle of Md. Code Ann. Cts. & Jud. Proc. 12-302(a) to cases under the Election Article, and (ii) where the Election Article authorizes judicial review but is silent regarding an appeal, Md. Code Ann. Cts. & Jud. Proc.12-301 authorizes an appeal; and (2) reversed the circuit court's judgment and remanded with instructions to order that the ordinance be placed on the ballot at the general election in accordance with the referendum provisions of the County charter, holding that the ordinance was simply a local ordinance re-zoning an area, and as such, it was not exempt from a referendum. Zaiser v. Jaeger
Steven Zaiser, as Chairman of the Sponsoring Committee for the Statutory Initiative Relating to the North Dakota Medical Marijuana Act, asked the Supreme Court to order Secretary of State Alvin Jaeger to place an initiated measure for the Medical Marijuana Act on the November 6, 2012, general election ballot after the Secretary of State rejected 7,559 signatures on circulated petitions and decided the measure did not qualify for placement on that ballot. The Sponsoring Committee claimed that although the submitted petitions included some elector signatures forged by petition circulators, the petitions contained sufficient valid signatures to place the measure on the ballot. Because of time constraints for placing the measure on the November 6, 2012, ballot, the Supreme Court issued a dispositive order on September 19, 2012, denying the Sponsoring Committee's request for relief and stating a written opinion would be filed at a later date. Because the circulators' petitions at issue in this case included signatures forged by the circulators in violation of a mandatory constitutional provision, the Secretary of State correctly rejected those petitions in calculating the number of elector signatures necessary to place the measure on the November 6, 2012, ballot and correctly determined the remaining petitions contained insufficient signatures to place the measure on that ballot.

Marcille v. Dauzat
The issue before the Supreme Court in this case concerned Defendants’ entitlement to trial by jury. Specifically, whether the Court’s holding in "Beauclaire v. Greenhouse" mandated that a resolution in accordance with La. R.S. 13:5015, waiving the prohibition against jury trials in suits against a political subdivision, must be passed by the political subdivision prior to a plaintiff filing suit for the political subdivision to be entitled to a trial by jury.
Upon review of the applicable statutory and case law authority, the Supreme Court found that Defendants were entitled to trial by jury, and therefore reversed the rulings of the lower courts.

Lair, et al v. Bullock, et al
The district court concluded that the State of Montana's contribution limits in Montana Code Annotated 13-37-216 were unconstitutional under the First Amendment and permanently enjoined the State from enforcing its campaign contribution limits. The State sought a stay of the district court's order, pending appeal. The court concluded that the state was likely to succeed on appeal. The court concluded that the State had made a strong showing that a merits panel of the court would likely conclude that, absent en banc proceedings or an intervening decision of the Supreme Court, the court remained bound by its decision in Mont. Right to Life Ass'n v. Eddleman. The court also concluded that a merits panel was likely to hold that the analytical framework of the Supreme Court's decision in Randall v. Sorrell did not alter the analysis of Buckley v. Valeo or Nixon v. Shrink Missouri Government PAC in a way that affected the court's decision in Eddleman. In light of the State's interest in regulating campaign contributions, the lack of evidence that other parties would be substantially injured, and the public's substantial interest in the stability of its electoral system in the final weeks leading to an election, the court will stay the order pending the state's appeal. NE Coal. for the Homeless v. Husted
Ohio requires that provisional ballots be cast in the correct precinct, with a completed voter affirmation, making no exception for wrong-precinct and deficient-affirmation ballots caused by poll-worker error, O.R.C. 3505.183(B)(4)(a)(ii)–(iii) and (B)(4)(b)(ii). A 2010 consent decree required the counting of certain wrong-precinct and deficient-affirmation provisional ballots where poll-worker error caused the nonconformity and the voters used the last four digits of their social security number for identification to cast their ballots. The ballot of a provisional voter using any other form of identification (e.g., current photo identification, current utility bill, paycheck) would not be counted.The district court denied a motion to vacate the decree and entered a preliminary injunction requiring the counting of all wrong-precinct and deficient-affirmation provisional ballots to remedy systemic exclusion of nonconforming ballots caused by poll-worker error. The Sixth Circuit affirmed the wrong-precinct remedy and reversed the deficient affirmation remedy and remanded for the district court to address the equal protection issue created by the consent decree’s provision for counting deficient-affirmation ballots by voters providing social security numbers, and a motion to modify the consent decree in light of the equal protection concerns raised by the consent decree’s differential treatment of provisional ballots. Busefink v. State
In 2008, the Association of Community Organizations for Reform Now, Inc. (ACORN) hired voter registration canvassers in Las Vegas. Under an incentive program, ACORN paid canvassers $5 a bonus if the canvasser returned twenty-one or more voter registration applications. The State subsequently charged ACORN and the supervisor of ACORN's field director for Nevada with several counts of violating Nev. Rev. Stat. 293.805, which prohibits providing compensation to voter registration canvassers based upon the total number of voters a canvasser registers. The supervisor entered an Alford plea to two counts of conspiracy to commit the crime of compensation for registration of voters, and was adjudged guilty. The Supreme Court affirmed, holding (1) section 293.805 triggers a less exacting standard of review than strict scrutiny; (2) the State demonstrated an interest sufficiently weighty to justify the limitation imposed on canvassing activities, and therefore, section 293.805 does not violate the First Amendment; and (3) section 293.805 is not unconstitutionally vague. Obama for Am. v. Husted
In July 2012, Obama for America, the Democratic National Committee, and the Ohio Democratic Party filed a complaint, alleging that Ohio Rev. Code 3509.03 was unconstitutional insofar as it imposed on non-military voters a deadline of 6:00 p.m. on the Friday before Election Day for in-person early voting. Military service associations were allowed to intervene. The district court entered a preliminary injunction, finding that the statute violated the Equal Protection Clause. The Sixth Circuit affirmed, finding the plaintiffs likely to succeed on the merits. Neither of the state’s justifications was sufficient to justify the distinction imposed by the law.
