Once removed from office, a justice court judge may not return to it by reelection or otherwise Former Justice Court Judge Rickey Thompson challenged the Lee County Democratic Executive Committee’s decision to withhold his name from the general-election ballot for a new term as a justice court judge, based on the Court’s order removing him from the office of justice court judge prior to the election. The circuit court dismissed Thompson’s case, finding him ineligible for judicial office. The Mississippi Supreme Court concurred with the circuit court and affirmed. Thompson also claimed that the proper procedures for removing him from the ballot were not followed, as neither the Mississippi Commission on Judicial Performance nor the Lee County Election Commission had authority to disqualify him. Because the Supreme Court held that Thompson’s removal was permanent, it did not address whether the proper procedures for removing him from the ballot were followed. View "Thompson v. In 1976, Nevada’s voters approved the creation of the Commission on Judicial Discipline through constitutional amendment. In this case, a group of individuals within the City of North Las Vegas sought to remove a municipal judge through a special recall election rather than through the system of judicial discipline established by the majority of voters in 1976. The municipal judge sought an emergency injunction from the district court and also filed a complaint challenging the legal sufficiency of the recall petition. The district court denied all of the municipal judge’s claims, concluding that judges are “public officers” subject to recall under the Nevada Constitution and that the form of the petition did not violate the judge’s constitutional rights. The Supreme Court reversed, holding that the recall petition against the municipal judge was invalid because the drafters of the constitutional amendment at issue and the electorate who approved it intended that recall no longer be an available means of removing a judge from office. The Individuals with Disabilities Education Act (IDEA), intended “to ensure that all children with disabilities have available to them a free appropriate public education,” 20 U.S.C. 1400(d)(1)(A), permits parents and legal guardians to recover reasonable attorneys’ fees and costs if they prevail in certain statutorily prescribed proceedings. In calculating a fee award, courts consider the “number of hours reasonably expended in litigation” and the “reasonable hourly rate,” determined in part by reference to the prevailing market rate for attorneys’ services. The plaintiffs, having prevailed in IDEA proceedings, sought attorneys’ fees and costs related to those proceedings and an award of “fees-on-fees” for work done in connection with their pursuit of fees for the IDEA proceedings. The district court granted both requests, but did not award the full amounts requested. The D.C. Circuit reversed in part, agreeing that the district court erred in excluding certain hours spent at “settlement conferences.” The court upheld determinations that the IDEA matters were not “complex federal litigation” to which the Laffey Matrix should apply and to apply the same rate to the initial fee and fees-on-fees awards. Plaintiffs forfeited claims raised for the first time on appeal: that their affidavits independently demonstrated a prevailing IDEA market rate that aligns with the Laffey Matrix and that the rates awarded were insufficient to attract competent counsel. Months before the 2012 presidential election, based on a change in state law, Ohio sought to undo a federal consent decree (Decree) that required Ohio to count provisional ballots cast by voters who appeared in the correct polling location but lacked certain identification and ballots cast in the right polling place but wrong precinct due to poll-worker error. In the NEOCH decision, the Decree was upheld and extended for one presidential cycle; the SEIU plaintiffs obtained injunctive relief requiring Ohio to count the votes. The plaintiffs sought attorneys’ fees under 42 U.S.C. 1988 for their 2012 work defending the Decree, their 2013 work obtaining an extension of the Decree, and the work performed to obtain a 2012 preliminary injunction and a 2013 permanent injunction. Using the lodestar method, the court awarded fees in both cases, limiting the fees for pursuing fees to 3% of the main case, citing the Sixth Circuit’s Coulter rule (capping fees for fees). The court awarded $2 million in fees to 25 attorneys for over 6,000 hours in the two cases. The Sixth Circuit affirmed, as reasonable, the hours and rates, except rates awarded to attorneys from California, and abrogated the Coulter 3% cap on fees for fees as inconsistent with intervening Supreme Court authority. On February 5, 2016, Governor Sam Brownback received statutorily required notice of District Magistrate Judge Tommy Webb’s departure from the bench. On June 15, 2016, three judges filed this petition for a writ of mandamus seeking a writ requiring the governor to immediately appoint an interim district magistrate judge for Haskall County. Specifically, Petitioner alleged that the governor failed to appoint a successor district magistrate judge in violation of Kan. Stat. Ann. 25-312a, which states that any “appointment made by the governor…shall be made within 90 days following receipt of notice….” The Supreme Court denied the petition for writ of mandamus, holding that the ninety-day time limit for the governor’s appointment of a district magistrate judge is directory rather than mandatory under precedent and is thus a discretionary act not subject to mandamus. Colleen O’Toole is currently a judge and announced her intention to run for election in 2016 to one of the three contested seats on the Supreme Court of Ohio. O’Toole and her judicial campaign committee challenged the constitutionality of several provisions of the Ohio Code of Judicial Conduct, including Rule 4.4(E) and sought a temporary restraining order and preliminary injunction only with respect to Rule 4.4(E) which states that: The campaign committee of a judicial candidate may begin soliciting and receiving contributions no earlier than one hundred twenty days before the first Tuesday after the first Monday in May of the year in which the general election is held. If the general election is held in 2012 or any fourth year thereafter, the campaign committee of a judicial candidate may begin soliciting and receiving contributions no earlier than one hundred twenty days before the first Tuesday after the first Monday in March of the year in which the general election is held. The district court denied relief. The Sixth Circuit affirmed, finding that the campaign committee failed to demonstrate likelihood of success on the merits or likelihood of irreparable harm. Florida voters elect judges. The Florida Supreme Court adopted Canon 7C(1) of its Code of Judicial Conduct, stating that judicial candidates “shall not personally solicit campaign funds . . . but may establish committees of responsible persons” to raise money for election campaigns. Yulee mailed and posted online a letter soliciting financial contributions to her campaign for judicial office. The Florida Bar disciplined her for violating a Bar Rule requiring candidates to comply with Canon 7C(1). The Florida Supreme Court upheld the sanction against a First Amendment challenge. The U.S. Supreme Court affirmed. Florida’s interest in preserving public confidence in the integrity of its judiciary is compelling.. Unlike the legislature or the executive, the judiciary “has no influence over either the sword or the purse,” so its authority largely depends on the public’s willingness to respect its decisions. Canon 7C(1) raises no fatal underinclusivity concerns. The solicitation ban aims squarely at the conduct most likely to undermine public confidence in the integrity of the judiciary: it is not riddled with exceptions. Allowing a candidate to use a committee and to write thank you notes reflect Florida’s effort to respect the First Amendment interests of candidates and contributors. Canon 7C(1) is not overinclusive It allows judicial candidates to discuss any issue with any person at any time; to write letters, give speeches, and put up billboards; to contact potential supporters in person, on the phone, or online; and to promote their campaigns through the media. Though they cannot ask for money, they can direct their campaign committees to do so. Florida has reasonably determined that personal appeals for money by a judicial candidate inherently create an appearance of impropriety. In response to time demands of this primary election appeal, the Pennsylvania Supreme Court entered a per curiam order on an expedited basis vacating the order of the Commonwealth Court and directing that Appellee Michael W. Beyer’s name be stricken from the primary ballot for the Democratic Party nomination for the Office of Representative in the General Assembly for the 131st Legislative District. In the per curiam order, the Court stated that an opinion would follow; this was that opinion. Beyer filed nomination petitions with the Department of State seeking placement of his name on the ballot for Democratic Nomination for the Office of Representative in the General Assembly. Appellant Objectors, qualified electors residing in the 131st Legislative District, petitioned to set aside the nomination petition on grounds that Beyer intentionally misrepresented his occupation as “lawyer” on both his Statement of Financial Interests (SOFI) and nomination petitions. At a hearing, .Beyer confirmed he had graduated law school, but had yet to pass or even take any state’s bar examination. Consequently, he was not licensed to practice law at the time he circulated his nomination petitions. He listed his occupation as “lawyer,” he said, because he understood the definition of “lawyer” as found in the Oxford English Dictionary to include someone who studied the law. He therefore thought it fair comment to describe his profession or occupation as “lawyer” on his nomination petition. Though she found that he likely used the title of “lawyer” to “enhance his stature with the electorate,” the trial judge accepted Beyer's explanation that he believed his having studied law and graduated law school in the past, alone, entitled him to claim the occupation. Appellant Objectors contended the Commonwealth Court erred in failing to find that Beyer’s self-designation as a lawyer-by-occupation represented a material defect borne of the intent to mislead the electorate. The Supreme Court agreed: the defect was both material to an elector’s decision to nominate a legislator and incurable by amendment because the candidate knew his representation had the potential to mislead signers about his credentials for the legislative office he sought. Having demonstrated as much, Objectors met their burden of disproving the presumptive validity of the contested nomination petition. Striking Mr. Beyer’s petition under such circumstances to avoid misleading the electorate was consistent with the Election Code’s purpose of protecting, and not defeating, a citizen’s vote. On May 15, 2012, Karl H. Lewies won the primary election for the position of Fremont County Prosecuting Attorney. Because he had no opponent in the general election, he knew he would be elected as the prosecuting attorney, and he was. He was scheduled to be sworn into office on January 14, 2013. On November 23, 2012, he filed two petitions for review against the county commissioners of Fremont County. One petition for review was on behalf of Flying "A"Ranch, Inc., and others, and the other petition was on behalf of E. C. Gwaltney, III. The petitions sought to overturn the designation by the county commissioners of certain roads as being public roads rather than private roads. In early 2013, the county commissioners, represented by Blake Hall, the deputy prosecutor hired by the prosecutor that Lewies had defeated in the primary, filed motions in both cases seeking to have Lewies disqualified from representing the petitioners in those cases. Lewies filed motions in both cases to withdraw as counsel for the petitioners. In each of the cases, Lewies had named two of the commissioners in both their official and individual capacities. The commissioners filed motions in both cases to dismiss the actions against them in their individual capacities. Substitution counsel entered appearances for the county commissioners in both cases. The court made preliminary rulings that Lewies could not represent any parties in the two cases; that the county would be awarded attorney fees against him personally for having to file the motion to disqualify; that an action against the two commissioners in their individual capacities could not be joined with a petition for judicial review; and that attorney fees would not be awarded against Lewies for having named them in their individual capacities. During the hearing, Lewies contended that substitution counsel should have been disqualified from representing the commissioners and that a deputy prosecutor should represent them. Ultimately the trial court entered a written order affirming its preliminary rulings. After several hearings, the court entered its memorandum decision in both cases awarding the county attorney fees in the sum of $1,185.00 against Mr. Lewies personally pursuant to Rule 11(a)(1), and Lewies appealed. Plaintiffs filed a complaint and moved for a temporary restraining order and preliminary injunction, alleging section 16, article V, of the Iowa Constitution, as implemented by Iowa Code sections 46.2, 46.4-46.10, and 46.14, violated their Fourteenth Amendment right to equal protection under the laws. The court concluded that the State Judicial Nominating Commission was a "special limited purpose" entity for its sole function was to select the most qualified candidates for judicial appointments and forward the names of these candidates to the Governor for a final appointment. This narrow function had a disproportionate effect on a definable group of constituents - members of the Iowa Bar - over other voters in the state. Therefore, the election of the attorney members of the Commission was an election of special interest. Applying rational basis review, the court agreed that the district court's Iowa system of election for the Commission's attorney members by and from members of the Iowa Bar was rationally related to Iowa's legitimate interests. Therefore, Iowa's system did not violate plaintiffs' rights under the Equal Protection Clause. Accordingly, the court affirmed the judgment. View "Carlson, et al. v.
