Turtle Mountain Band of Chippewa Indians v. Howe
In 2021, the Turtle Mountain Band of Chippewa Indians, Spirit Lake Tribe, and three individual Native American voters filed a lawsuit against North Dakota’s Secretary of State. They claimed that the state's 2021 redistricting plan diluted Native American voting strength, violating Section 2 of the Voting Rights Act (VRA) and 42 U.S.C. § 1983. Section 2 of the VRA prohibits vote dilution, which can occur through packing a minority group into one district or dividing them among several districts to weaken their voting power.The United States District Court for the District of North Dakota denied the Secretary's motion to dismiss, which argued that private plaintiffs lacked a cause of action under Section 2 and could not use § 1983 to enforce it. The district court allowed the case to proceed, and after a bench trial, it ruled that the 2021 redistricting map violated Section 2. The court permanently enjoined the Secretary from using the map and ordered the North Dakota Legislative Assembly to adopt a remedial map. When the Assembly failed to do so, the court imposed the plaintiffs' proposed map.The United States Court of Appeals for the Eighth Circuit reviewed the case. The main issue was whether private plaintiffs could enforce Section 2 of the VRA through § 1983. The court held that Section 2 does not unambiguously confer an individual right enforceable under § 1983. The court emphasized that Section 2 focuses on the entities regulated (states and political subdivisions) rather than unambiguously creating individual rights. Rancheria v. Martin
Plaintiff Greenville Rancheria (Greenville) was a sovereign Indian tribe that owned administrative and medical offices (property) in the City of Red Bluff. Following a contested election, defendant Angela Martin was elected as Greenville’s chairperson, which included the authority to act as Greenville’s chief executive officer. After her election, Martin, along with approximately 20 people, including defendants Andrea Cazares-Diego, Andrew Gonzales, Hallie Hugo, Elijah Martin, and Adrian Hugo, entered the property and refused to leave despite the remaining members of the tribal council ordering them to leave and removing Martin’s authority as chairperson under Greenville’s constitution. Because of defendants’ failure to vacate the property, Greenville filed a verified emergency complaint for trespass and injunctive relief. The trial court granted Greenville a temporary restraining order, but later granted defendants’ motion to dismiss the complaint for lack of subject matter jurisdiction. Greenville appealed. The Court of Appeal reversed: defendants did not point to any authority demonstrating the federal government’s intent to preempt state law or deprive state courts of subject matter jurisdiction in property disputes between tribal members occurring on lands outside tribal trust lands. "To conclude we lack jurisdiction over property disputes between tribal members on nontribal lands would limit tribal members’ access to state court, especially considering California courts have subject matter jurisdiction pursuant to Public Law 280 over property disputes between tribal members on tribal trust lands. (Section 1360.) Consequently, the state court has jurisdiction to hear Greenville’s dispute against defendants regarding land it owns in fee simple that is not held in trust by the federal government." Yazzie v. Hobbs
In late August 2020, Yazzie initiated an action challenging Arizona's Receipt Deadline pursuant to Section 2 of the Voting Rights Act of 1965 (VRA), the Equal Protection Clause of the United States Constitution, and the Arizona Constitution's election clause. The complaint alleges that Navajo Nation reservation residents face myriad challenges to voting by mail where many on-reservation members do not have home mail service. Rather, to receive or send mail, they must travel to a post office. Furthermore, socioeconomic factors, educational disadvantages, and language barriers make both the travel to the post office—which requires access to a car—and the completion of mail ballots difficult. Yazzie also claims that these mail ballots take disproportionately longer to reach the county recorder's office because of the slower mail service on the reservation. In late September 2020, the district court denied Yazzie's motion for preliminary injunction based on its finding that Yazzie did not demonstrate a likelihood of success on the merits or raise serious questions going to the merits of Yazzie's VRA claim.The Ninth Circuit affirmed the district court's denial of Yazzie's request for a preliminary injunction. The panel did not address the district court's analysis of the VRA claim because it concluded that Yazzie and the other plaintiffs lack standing. The panel stated that not only does Yazzie fail to make a clear showing of a concrete and particularized injury, noticeably absent in the record is any particularized allegation with respect to any of the six individual plaintiffs. The panel also stated that, importantly, this case is not a putative class action filed on behalf of the Navajo Nation members who reside on the reservation. In this case, Yazzie failed to establish injury-in-fact for at least one of the individual plaintiffs in the lawsuit. The panel concluded that also missing is a clear showing that the alleged injury is redressable by a favorable decision by this court. View "Yazzie v. Hobbs" on Justia Law
Navajo Nation v. San Juan County
In 2012, the Navajo Nation and several of its individual members sued San Juan County, Utah alleging that the election districts for both the school board and the county commission violated the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution and the Voting Rights Act (VRA) of 1965. The district court denied the county’s motion to dismiss, found that the election districts violated the Equal Protection Clause, and awarded summary judgment to the Navajo Nation. It later rejected the county’s proposed remedial redistricting plan because it concluded the redrawn districts again violated the Equal Protection Clause. The district court then appointed a special master to develop a proposed remedial redistricting plan, directed the county to adopt that remedial plan, and ordered the county to hold special elections based on that plan in November 2018.
On appeal, the county challenged each of the district court’s decisions. Finding no reversible error, the Tenth Circuit affirmed. View "Navajo Nation v. San Juan County" on Justia Law
Paquin v. City of St. Ignace
Plaintiff Fred Paquin served the Sault Ste. Marie Tribe of Chippewa Indians (the Tribe), a federally recognized Indian tribe whose territory was located within the geographic boundaries of Michigan, in two capacities: as the chief of police for the tribal police department and as an elected member of the board of directors, the governing body of the Tribe. In 2010, plaintiff pleaded guilty to a single count of conspiracy to defraud the United States by dishonest means in violation of 18 USC 371, for which he was sentenced to a year and a day in prison. The underlying conduct involved the misuse of federal funds granted to the tribal police department. In both 2013 and 2015, plaintiff sought to run for a position on defendant’s city council in the November general election. Plaintiff was rebuffed each time by defendant’s city manager, who denied plaintiff’s request to be placed on the ballot. In each instance, defendant’s city manager relied on Const 1963, art 11, sec. 8 to conclude that plaintiff’s prior felony conviction barred him from running for city council. Plaintiff brought the underlying declaratory action in the Mackinac Circuit Court, seeking a ruling that his position in tribal government did not constitute employment in “local, state, or federal government” under Const 1963, art 11, sec. 8. The Michigan Supreme Court determined that tribal government did not constitute "local...government." Accordingly, the Court reversed the Court of Appeals and remanded this matter back to the circuit court for further proceedings. View "Paquin v. City of St. Ignace" on Justia Law
